法律帮助-起诉一个roof公司？

去年，我发现我的房子漏水。在当地一家屋顶（roof)公司的帮助下，我从房子保险公司拿到换屋顶所有的钱(支票)。然后把它交给该公司。现在半年后，该公司甚至不接我的电话。有人可以帮助起诉该公司吗？或一些其他的建议。

该公司如果还存在，可以到Small Claim 法庭去起诉。如：

You can bring them to the court. But if the roof company ceased to exist, the case goes nowhere. So the best way is hold your money until the work starts. Do you have a writen contract? If not, the court won't handle any verble promises. Good luck.

The case sounds too small. It is not worth doing so. If you can get close to $1 million, it is worth doing so.

I got a 9200$ check from my home insurance company for roof with a help from Atlanta Quality Roofing. Once I got this check, I handled it over to this company because a person representing this company told me material will be purchased. This company withdraw all money next day. I contact this company and I never get answer. I have all written contractor and a photocopy of check. Is there some chance to get some money back?

Sounds like you get duped, if you can find the owner of this company, take him to court, but then even if you win the case, if he does not have the money, you are still duped.  It will be hard to recover your money......... good luck!

Also, last year's issue why wait till now? The insurance co. issued the check to you, you handled over to him, how can he cash a third party check?  Strange.

It seems that you were cheated by this roof company. Actually You can claim the roof damages by yourself without any roof company. The insurance check should be written in your/owner name, not others. You can deposit into your own account, and then find a good deal roof company. In addition, the roof company must sign a contract with you and complete the whole roof work, then you can pay the whole charge. For example, I got $7500 insurance check for roof damage in 2009, and paid $5000 to  a roof company after they completed the work.
