房屋管理注意事项1

当我们找到房客后,我们需要与房客签合同,在签合同之前我们有必要和房客一起检查房子的状况,每个房间的状况都要记录下来,几把钥匙,双方要在move-in inspection 搬进房屋检查表上签字. 我们要保留好这个文件。

当房客搬走的时候,房客和房东或管理公司需要拿出以前签的搬进房屋检查表move-in and move-out inspection,再次检查看看是否有什么东西损坏,对照以前的记录。关键的问题是遇到有损坏东西的时候,房东要在房客搬出日期三天以内检查并告诉房客是否房客需要赔偿的估计。如果超过三天,房东没有给房客赔偿价格的话,房东就必须退还房客全部定金,如果房客告房东的话,还可以索取其他的赔偿。这里我们要注意,有些出租合同误导,以为房客搬走后30天内退定金就可以了,其实不准确。

今年有一房东没有在三天内提供估算的修理价格,房客他就找律师要求房东退还全部定金,威胁要退还定金的三倍的赔偿。几经交涉才达成协议。所以房东和管理人员一定要赶紧在房客搬出三天以内告诉房客修理估算,房客要在搬出房子后五天以内检查房子,确定修理项目金额。
另外收到定金后房东一只要将定金存入escrow 账户,如果房东没有提供搬进搬出项目而扣留房客的定金,房东就可能被罚三倍定金的金额和律师费。以下是法律条款供参考。

·        RequireItemized List of Move-Out Damages and Charges: Within three business days after thedate of the termination of occupancy, the landlord shall inspect the premisesand compile a comprehensive list of any damage done to the premises which isthe basis for any charge against the security deposit, along with the estimateddollar value of such damage. The tenant shall have the right to inspect thepremises within five business days after the termination of the occupancy inorder to ascertain the accuracy of the list. (O.C.G.A. § 44-7-33) This is not applicable to owners and family members whocollectively own ten or fewer rental units, unless those units are managed by athird party for a fee. (O.C.G.A. § 44-7-36)
· Record Keeping of Deposit Withholdings: No Statute
· ·  Failure to Comply: The landlordforfeits any right to withhold a deposit if the money was not originallydeposited in an escrow account, or if landlord did not provide move-in/move-outinspection lists. Any landlord who intentionally and wrongfully withholds adeposit may be liable for 3x the amount withheld plus attorney’s fees. (O.C.G.A. § 44-7-35)

谢谢提醒,看来您是碰上了难缠的房客了。
标准GAR 的租房合约里有这个3天/5天一说的,一般就忽略了。
以后一定注意。

Please also note this part:

"This is not applicable to owners and family members who collectively own ten or fewer rental units, unless those units are managed by a third party for a fee. (O.C.G.A. § 44-7-36)"

So if you own 10 or fewer rental units and mange the rental yourself, this law does not apply to you.
