如果您把您因此事头痛,生气,夫妻吵架,耽误孩子上学,另外花了很多时间发帖都算上,账单会更高。

还有,您的房租是2000元一个月,您找到了一位有执照的经纪人,愿意只收取500元替您出租。地产业通常是收取一个月的房租,您已经节省了1500元,应该很高兴啊。

It is clear that the judge made a mistake by applying the wrong law.  However, that doesn't guarantee you will win the case because, after vacating the wrong judgment, the court could find other laws/stipulations in tenent's favor.  Foe example, the deposit might be interpreted as conditional upon satisfactory inspection, or it might be intended for early termination after moving in first.  The fact they didn't move in and it had mold, which can be a severe health hazard to certain people, will weigh heavily in their favor.  Another point is that even if they are at fault,you cannot attribute 100% of your one month loss to them.  They are only responsible for the days between the date of agreement and the date of backing off, which is 2 weeks?

July 19, they put down $4000.  That is the date of contract.  They backed out on July 26.  So they only delayed you for 7 days, during which you took the rental off market, not a month.

I know it’s hard to tell the whole story in every detail.

I paid $500 just for putting my ad in their professional web, that’s all I got from real estate agent. So it’s totally different from the service you would get from real estate agent when you pay one month rent.

Who will move in to a $2000/month house that had mold issue, broken cabinet and bad lighting fixture? LZ, put yourself in the same situation, would you take the house as well? Be fair please! just let it go and fix up your house for your next tenant!  It's just a waste of time and money if you go to higher court to appeal.

Thanks for all your comments, guys in this Chinese community!
I was expecting good comments from experts based on laws, instead I saw most of people just expressed what they thought is right or not right, and a lot of misunderstanding/confusions. I know it's hard to explain everything in every detail.
But I thank you for your time and frank talking. I decided to go ahead to the higher court. Good luck to myself!

I think now many Chinese have rental houses, and may have different issues dealing with tenants, it’s good to share our experience.
Below is my case:
During July 10 – 19, I had walk through with a prospective tenant couple twice for my rental house. On July 26, this couple made $4000 security deposit (two month rent as his credit score was very low), and we signed the lease which would begin Aug 1. On July 26, I had move-in inspection with this tenant. During this inspection, this couple found the restrooms with mildew in the master bedroom, the upstairs restroom cabinet detached, blown out lights, etc. and didn’t want to move in and request all security deposit back to them. I didn’t agree and on July 31, I told them that every repair them mentioned was taken care of, they still didn’t want to move in. as such my rental house was vacant for a month. We went to small court. The judge ruled against me based on GA law (44-7-33), I admitted to the judge that I didn’t give the couple a comprehensive list of any existing damages since I had no idea if anything was wrong as the previous tenant emailed me that the house was in good condition when they moved out.
