I would DEFINITELY NOT accept half of the rental unless you have no intention to evict this tenant. Once you allow partial rental, it may become very difficult to evict the tenant if the tenant knows how to play the ball.

Since he accepted partial rental, I guess the tenant may continue paying $100 or $200....each month. It's difficult to evict him now.

Accepting partial rent doesn't necessarily mean you can't evict the tenant. Most rental contract gives landlord rights to evict if they didn't receive full rent on time. Actually, accepting half rent is a good tacticle move, since it reduce your loss on this tenant and keep the eviction option open.

The issue is how to deal with this tenant going forward, which is solely on the discretion of manager and landlord. I believe LaoGuo has enoguh experience of this kind of situation and come out OK. :-)

Interesting. I remember I read the GA law on this issue.

My understanding is you can accept full or partial payment once the eviction process has been filed. That's perfect ok.

But in LAOGE's case, I doubt it. It's difficult for him to reject partial payment down the road, and difficult to evict.

Any real-estate lawer on this board can clarify on this?

One thing you should realize is that Eviction is not your goal, rather it is the last resort for you to take your property back. Eviction is a legal process that takes time and money. If you can reach a MUTUAL agreement with your tenant on terms of either stay or move-out, you should avoid eviction, since in a mutual agreement process, tenant is still taking voluntary action to vacate the property, hopefully leaving you with less headache to deal with.

向网友汇报一下，我们已经跟保险公司联系，保险公司也表示，今天会来人，说是要把地板扒下来，好让地板吹干。至于隔壁邻居的损失，保险公司要我们重新再申请一个索赔，是叫做责任事故，我的理解是，就像车撞了别人，保险公司赔自己车是一种赔偿，然后赔对方又是另一种赔偿。所以现在正在跟保险公司联系，给邻居赔偿。

刚才保险公司来电话， 不赔邻居的， 要房客负责。理由： 洗衣机是房客自己的，房客自己没管好那个洗衣机。

另外，那个“病人”房客的租金拿到了一半。
