09年4月，我在Dekalb被开了一张交通罚单。还在2009年9月16号上了法庭，我当时并不服罪，法院让我回家等待另行通知。但是我等了好久，直到昨天，我才收到一封信，说如果我到2010年4月16号还不解决好这张罚单的话，就会暂停我的驾照。我打电话到法院，他们说他们在2010年2月18号发出了一封信要求我出庭，但是我却没有按时出庭。可是我根本就没有收到这样一封信。现在他们说我必须为那张罚单出$300+，来解决这个问题。我想请问一下是否有人有过类似的经验。如果从法律角度出发的话，怎样解决这个问题最好，谢谢！

Something ordinary happened to me a year ago, but something strange happened to me last week, I wonder if you have encountered similar situations and may offer me some helpful advices or insider's knowledge, or maybe someone you know can help me solve the problem.
A year ago my parents and I went shopping and came to a traffic light at an intersection, suddenly a car on my right cut in front of me and caused mine to became the last car in line and stuck out a bit at the intersection, a cop caught up with me and gave me 2 tickets, one for running a red light, one for obstructing traffic, but I didn't run the red light, and the left side of the intersection was in construction, no traffic. I told her about the car that cut in front of me, she said I'd better tell a judge. So I appeared in Dekalb county court last Sep. and pleaded not guilty, I was told to go home for further notice. So I waited and waited, nothing happened until last week, two letters showed up in my mailbox, saying that I missed court appearance and have to resolve the two tickets by 4-16-2010, or have my driver's license suspended, so I called the court and they said letters were sent out on Feb. 18 for me to appear in court in Mar. Since I never got those letters, I missed the court date, now they said I have to pay the fines. I left two messages explaining my situation and hope to get a new court date, but no one returned my call.
I wonder if this is a tactic in their system to get people to pay tickets, if you plead not guilty, they don't send you any notification, until later say you missed the court date and have to pay or suspend your license. If I missed the date, why can't we make a new date on the phone, so both parties are sure to know that we agreed on a court date, rather then not giving me a chance to appear in court. I know the economy is bad, government is running out of money, schools are closing down, but this is not a way to force people to pay tickets, I believe the law is fair, but now it becomes unfair, the letters may intentionally or unintentionally never been sent out, or they may have been lost in the post office, why the lose of those letters automatically becomes my fault ? Do they have signatures saying I got the letters ? No.
I'm not trying to avoid paying the tickets, I believe I AM NOT GUILTY, and want to discuss it with a judge, I have taken pictures of the intersection and drew a chart [attached] to explain the situation, I've been waiting for the court date for a long time, now I don't have a chance, if the letter was lost in the mail, why can't we reschedule and why it automatically becomes my fault, I don't mind paying for the tickets if a judge says I was at fault !
I wonder if you or other people have similar experiences and from a legal stand point, what's the best way to resolve this, thanks ! |
