The latest iPhone OS is 3.1.x. It comes with all the iPhone 3G(s) and 3G. But it is not a big deal which version of iPhone OS you have. Whenever an new version of OS comes, you will know it when you connect iPhone to iTune on your pc/Mac. And iTune will ask you to udpate, and it's automatic.
I think your choice is between the iPhones, the latest 3Gs, or the old version, 3G. 3Gs is faster to run app (s -> speed), and has video recording features. Among the 3Gs, there are 8G and 16G version. If you don't plan to recording a lot of video, 8G space should be enough.
To restore your songs and apps back to your iPhone, Apple made it simple. Just sync with your iTune in your pc/Mac! However, if you don't have backup songs and apps in your iTune, well, sorry ... (So make sure to sync with your iTune in your pc/mac every time after you purchase song or download app directly to your iPhone).
BTW, a personal suggestion: once you get your iPhone, make sure to download Pandora (free), you are going to love it!
